Cookie Consent Management is a system that helps websites or apps obtain and manage user consent for the use of cookies.

It must be ensured that any data processing requiring consent only takes place after the user has been fully informed and has actively consented. It must also be possible to provide evidence of this decision at a later date.

The technical implementation is carried out using Consent Management Platforms (CMPs). These systems store specific information about the choices made by users so that consent does not have to be requested again every time the same website is visited

  • Data protection: Ensures that users’ privacy is respected
  • Legal requirements: Many countries have laws requiring websites to obtain users’ consent for cookies (EU General Data Protection Regulation)
  • Transparency: Users know what data is being collected and can decide whether they agree to it

Cookies may generally only be set with the user’s prior consent. Website operators therefore need a cookie banner through which they can obtain consent to set cookies. Only technically necessary cookies are exempt from this consent requirement. Users must be able to modify or revoke their consent at any time via the consent management platform, a footer link, an icon, or similar means.

Technically necessary cookies are those that are absolutely essential (shopping cart, login, forms, language settings, etc.) for a website to function correctly and provide basic functionality. User consent is not required for these cookies. They may therefore remain active even if visitors click “Reject All” in the cookie banner.

For all other cookies that are not strictly necessary to provide the website, however, active consent must be obtained. These include, in particular, third-party cookies used for marketing, market research, or analytical purposes that track users’ browsing behavior.

When selecting and implementing a Consent Management Platform (CMP), there are several important points to consider – both technical and legal.

  • Active opt-in: Consent must be given voluntarily and actively (no pre-checked options)
  • Detailed selection: Users must be able to deselect specific purposes, such as marketing or statistics, individually
  • Opt-out button: An equivalent “Opt-out” button must be placed next to the “Agree” button
  • Pre-blocking: Tracking scripts (except those technically necessary) may only be loaded after consent is given
  • Withdrawal: It must be possible to easily withdraw consent at any time
  • Transparency: Clear information about data processors (providers) and purposes must be listed
